Terms of Service

These Terms apply to ArkFile Essentials and Complete for iPhone, ArkFile support, legal compliance pages, hosted download services, and any private or legacy web account services that remain reachable. These Terms do not limit rights you may have under the GNU General Public License or other open-source licenses that apply to ArkFile application code.

1. ArkFile Content Packs for iPhone

ArkFile Essentials, Complete, and the Essentials-to-Complete upgrade are purchased and restored in the iOS app through Apple's in-app purchase system. Installed content is intended to remain usable offline after download while the applicable purchase entitlement remains active.

2. Open-Source Application Code

ArkFile iOS includes GPL-covered application code derived from Kiwix/openZIM projects. Nothing in these Terms limits your rights to copy, inspect, modify, or redistribute GPL-covered application code under the applicable open-source licenses.

Matching corresponding source and release notices must be published no later than distribution through the Open Source page and ArkFile iOS source releases.

3. Paid Access and Hosted Services

Apple handles iPhone App Store payment processing. ArkFile may validate StoreKit transaction data to confirm Essentials, Complete, or upgrade access and provide user-triggered content download access. Account credentials, entitlement records, signed download URLs, StoreKit content tokens, and hosted service access may not be shared, sold, or used to bypass ArkFile access controls.

4. Content Licenses

ArkFile content packs include material from third-party sources. Content rights are governed by each source's own license, not by ArkFile's app-code license. Some content may allow redistribution with attribution or share-alike terms; other content may have different restrictions. See Licenses and Attributions.

5. Trademarks and Branding

The ArkFile name, logo, icons, and visual identity are ArkFile branding. GPL rights in application code do not grant permission to use ArkFile trademarks in a way that implies sponsorship, endorsement, or an official ArkFile release. Modified redistributions should remove ArkFile branding unless separately authorized.

6. No Affiliation

ArkFile is independent and is not affiliated with, sponsored by, or endorsed by Kiwix, openZIM, Wikimedia CH, Wikimedia Foundation, Apple, Posit PBC, or other referenced projects or organizations.

7. Informational Content Disclaimer

ArkFile contains reference materials, including medical, preparedness, survival, map, and educational content. This content is informational only and is not professional medical, legal, engineering, navigation, emergency, or safety advice. Verify critical information with qualified professionals and current official sources before acting.

8. Returns and Refunds

Refund handling depends on where the purchase was made and applicable law. App Store purchase refunds are handled by Apple. Review the Returns and Refund Policy before purchase.

9. Privacy

Purchase validation, support, download, account, and service-log handling is described in the Privacy Policy.

10. Updates

We may update ArkFile software, services, content packages, and these Terms. Material legal changes will be posted on this site. Continued use of ArkFile services after an update means you accept the updated Terms for those services.

11. Limitation of Liability

ArkFile software, services, and content are provided as available and without warranties to the maximum extent permitted by law. ArkFile is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from reliance on reference content.
