These Terms apply to ArkFile accounts, paid download services, support, and hosted services. They do not limit rights you may have under the GNU General Public License or other open-source licenses that apply to ArkFile application code.

1. Open-Source Application Code

ArkFile Desktop and ArkFile iOS include GPL-covered application code derived from Kiwix/openZIM projects. Nothing in these Terms limits your rights to copy, inspect, modify, or redistribute GPL-covered application code under the applicable open-source licenses.

2. Paid Service and Account Access

ArkFile v1 uses separate purchase paths. Desktop purchases made through ArkFile's website or desktop app provide access to desktop hosted download service, curated content packaging, account entitlement, updates, and support. iPhone purchases made through Apple's in-app purchase system provide access to ArkFile Essentials in the iOS app only.

Account credentials, entitlement records, signed download URLs, StoreKit content tokens, and hosted service access are personal to the purchaser and may not be shared, sold, or used to bypass ArkFile access controls.

3. Content Licenses

ArkFile content packs include material from third-party sources. Content rights are governed by each source's own license, not by ArkFile's app-code license. Some content may allow redistribution with attribution or share-alike terms; other content may have different restrictions.

4. Trademarks and Branding

The ArkFile name, logo, icons, and visual identity are ArkFile branding. GPL rights in application code do not grant permission to use ArkFile trademarks in a way that implies sponsorship, endorsement, or an official ArkFile release. Modified redistributions should remove ArkFile branding unless separately authorized.

5. No Affiliation

ArkFile is an independent project and is not affiliated with, sponsored by, or endorsed by Kiwix, openZIM, Wikimedia CH, Wikimedia Foundation, Apple, Posit PBC, or other referenced projects or organizations.

6. Informational Content Disclaimer

ArkFile contains reference materials, including medical, preparedness, survival, map, and educational content. This content is informational only and is not professional medical, legal, engineering, navigation, emergency, or safety advice. Verify critical information with qualified professionals and current official sources before acting.

7. Returns and Refunds

ArkFile is a digital product and download service. Refund treatment depends on where the purchase was made and applicable law. Please review our Returns and Refund Policy before purchase.

8. Privacy

Account, purchase, entitlement, support, download, and service-log handling is described in our Privacy Policy.

9. Limitation of Liability

ArkFile software, services, and content are provided as available and without warranties to the maximum extent permitted by law. ArkFile is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from reliance on reference content.

10. Updates

We may update ArkFile software, services, content packages, and these Terms. Material legal changes will be posted on this site. Continued use of ArkFile services after an update means you accept the updated Terms for those services.
